Eligibility
Red Carpet Canada Inc., (the “Sponsor”) is proud to present this exciting, FREE, no obligation sweepstakes, the RED CARPET® HOUSE Sweepstakes (the “Contest”). The Contest is open to all legal residents of Canada (Quebec residents are not eligible to enter) who have reached the age of majority in the province in which they reside on or before the Contest Closing Date and is void to individuals outside Canada and where prohibited by law. The Contest commences on or around January 1, 2009. To be eligible, all entries must be received by 11:59:59 P.M. EST (Eastern Standard Time) November 1, 2011 (the "Contest Closing Date"). Officers, directors, representatives and employees of the Sponsor, its parent, affiliates, or subsidiaries, their advertising, promotional, publicity, production or judging agencies, and all those living in the same household as the above individuals, are not eligible to enter. 

How to Enter
1. Obtain and complete an original Red Carpet® House Sweepstakes entry form from a participating real estate brokerage, agent, sales representative or broker throughout Canada. Mail the entry form bearing sufficient postage, to:

2. Visit the Contest at www.redcarpetcanada.com complete the online entry form by providing your name, address, e-mail address, telephone number, and confirm compliance with the Contest rules and submit your entry online to be automatically entered in the Contest. In the event of a dispute regarding submission of an online entry, the entry will be deemed submitted by the authorized holder of the e-mail account. The authorized account holder is the individual who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address. One Contest entry per envelope. Entries generated by a script, macro or other automated means are void. Entries that contain typographical errors, are altered, tampered with, incomplete, inaccurate, irregular in any way, or otherwise not in compliance with the Official Rules and Regulations, are also void. Proof of sending not deemed to be proof of receipt. All submitted material will become the property of the Sponsor and none will be acknowledged or returned. The selected entrant(s) will be notified by mail, e-mail or telephone. Entries are subject to verification and will be declared invalid if they are altered or tampered with in any way.

DRAW
The Sweepstakes begins on or about January 1, 2009. On the fifth business day of each month during the sweepstakes period (starting February 6, 2009 and until November 5, 2011), an independent judging organization will randomly select ten percent (10%) of the entries received, during the previous month. Those randomly selected entries will then be eligible for a final random draw, on November 21, 2011 (the "Grand Prize Draw Date"), in Saint John, NB, at or around 8:30 a.m. EST. The odds of being selected in any given month to qualify for the Grand Prize draw are 1 in 10. The odds of being selected in the Grand Prize draw depend on the total number of entries received.

The judging will be conducted by an independent judging organization whose decisions on all aspects of this Contest shall be deemed as final and binding in all respects. By entering, participants agree to be bound by the Contest rules and regulations and the decisions of the independent judging organization. This Contest is subject to all applicable federal, provincial and municipal laws.

Prizes
Prize must be accepted as awarded. No substitution, transfers or refunds will be allowed. However, Sponsor reserves the right to substitute a prize of equal or greater value in Sponsor's sole discretion.

The Grand Prize

The House Option
The single Grand Prize Winner may choose the designated house in Detroit, Michigan selected by the Sponsor (the “Grand Prize House”). The Grand Prize House is unfurnished and includes the structure and lot. All decisions related to the Grand Prize House shall be at Sponsor’s sole discretion. Actual value of Grand Prize House depends on market fluctuations. Sponsor will convey the Grand Prize House to the Grand Prize Winner without representations or warranties, express or implied. Real estate transfer taxes, deed recording charges and closing costs, shall be the sole responsibility of the Grand Prize Winner, as will all current and future real estate taxes and all other federal, state or local taxes, costs, fees, and expenses related to the maintenance of the house commencing as of the date the Grand Prize Winner accepts the Grand Prize. Title insurance and homeowner’s hazard and liability insurance shall be the sole responsibility of the Grand Prize Winner. Sponsor shall not be responsible for the condition of the Grand Prize House nor the condition of title. The Grand Prize House will be awarded “As Is”. Sponsor reserves the right to substitute a different house as the Grand Prize House up to the time it is awarded to the Grand Prize Winner in Sponsor’s sole discretion. All costs, taxes, fees, and expenses associated with a prize or the acceptance and use of any element of a prize not specifically addressed above are the sole responsibility of the respective Grand Prize Winner. Sponsor reserves the right to substitute any prize, or portions thereof, with a prize of comparable or greater value, at its sole discretion. Some restrictions apply.

The Cash Option
Alternatively, the Grand Prize Winner may choose to select ten thousand dollars ($10,000) in Cash in Canadian funds.

Claiming Your Grand Prize

In order to claim a prize and be declared a winner, the selected entrant will be required to:

1. Correctly answer, without assistance of any kind, the mathematical skill-testing question to be administered by mail or telephone at a pre-arranged mutually convenient time.

2. Complete and sign a declaration and release statement, in order to: confirm compliance with the rules and regulations, accept the prize as awarded, without substitution, release the Sponsor and its affiliated companies from any liability, as described more fully below, and consent to the use of his or her name, address (city and province), photograph, and likeness, as described more fully below.

Failure by any selected entrant to complete, sign and return any of the aforementioned documents within 14 business days after notification is sent to the address on the selected entrant's entry, or the return of prize documents as undeliverable, may result in forfeiture of the prize and selection of an alternate winner in the sole discretion of the Sponsor. If a selected entrant cannot be contacted in a timely fashion, or if for any other reason the prize cannot be awarded, another Contest entry will be randomly selected by draw until the prize has been awarded. Failure to correctly answer the skill-testing question will result in disqualification, the forfeiture of his or her interest in the prize, and the random selection of a substitute winner from among all remaining eligible entries. Communication will be entered into only with selected entrants.

Personal Information
The entrant consents to the Sponsor’s collection, use and disclosure of his or her personal information to any third party for consumer research, offer to provide real estate services, marketing and contest-administration purposes.

The entrant consents to receive product-related information from the Sponsor, for the purpose of notifying contest entrants of new products and obtaining customer feedback.

Sponsor reserves the right to conduct a background check on any potential Grand Prize Winner and reserves the right in its sole discretion to disqualify any person based on such background check if Sponsor determines in its sole discretion that awarding the prize to such potential Grand Prize Winner might reflect negatively on Sponsor or any of the Participating Product Sponsors.

No Responsibility
 The Sponsor assumes no responsibility for:

1. lost, delayed, destroyed, misidentified or misdirected entries, or entries deemed irregular by the contest Sponsor in its sole discretion, which are automatically void;

2. incorrect or inaccurate capture of entry information, technical malfunctions, human or technical errors, printing errors, lost, delayed or garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer line or network, computer equipment, software or any combination thereof, whether originating from sender or recipient; and

3. any problems, errors or negligence that may arise or occur in connection with the Contest including but not limited to any damage to an entrant's computer equipment, computer system, software or any combination thereof, any disclosure or publication of the entrant’s contact information as a result of the entrant's participation in this Contest.

The Sponsor makes no warranty with respect to the House Option and expressly disclaims all warranties express or implied with respect to the House Option, including but not limited to, any warranty of availability, quality, merchantability or fitness for a particular purpose of any prize offered. Sponsor shall not be liable for any direct, compensatory, indirect, special, or punitive damages whether by action in contract, tort (including negligence), strict liability, warranty, statutory right or any other basis with regards to the House Option even if Sponsor has been advised of the possibility of such damage or if such damage was foreseeable. Sponsor reserves all rights including the right to modify any aspect of the House Option or cancel the House Option at any time. The House Option is available in any province where permitted by law but void where prohibited by law.

Right to Cancel
The Sponsor reserves the right to cancel or modify this Contest if, in its sole discretion, it determines that for any reason this Contest is not capable of running as originally planned, or if fraud or any other occurrence compromises the fairness or integrity of this Contest. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole discretion, to cancel or suspend the Internet portion of this Contest should a virus, bug or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of this Contest.

Criminal Prosecution
Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

General Release and Indemnity
By entering this Contest, entrants agree to release and indemnify and hold harmless the Sponsor and its parent and affiliates, subsidiaries, advertising and promotional agencies, and their respective directors, officers, employees and agents, from any claim, loss, expense (including legal fees) or other liability which may be sustained in connection with the Contest, including, without limitation, any damages resulting from the receipt, ownership or use or misuse of a Prize, or while preparing for, participating in, and/or traveling to any prize-related activity.

No Warranties
The Sponsor shall not be liable to the winner of any prize for any guarantee, warranty, condition or representation, express or implied, relating to the prize, including, without limitation, its quality, condition or fitness for a particular purpose.

Publicity Release
By entering this Contest, entrants consent to the use of their name, age, address, photograph, likeness in any publicity related to this Contest carried out by the Sponsors, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, unless prohibited by law.

Governing Law
All disputes arising out of or in relation to the Contest shall be submitted to the courts of competent jurisdiction in the Province of Ontario. By entering the Contest you irrevocably submit to the jurisdiction of the court of Ontario and waive any objection you may have to the venue of said courts.
